COMMISSION TERMS OF SERVICE
By commissioning me and completing payment, you confirm that you have read and agreed to these Terms of Service, as well as the commission information shown on my Carrd at the time your commission is confirmed.
1. GENERALI reserve the right to accept or decline any commission request at my discretion.The commission will follow the scope, pricing, and conditions agreed upon before work begins.Any work outside the agreed scope may require an additional fee. This may include major revisions, additional design work, privacy requests, rush requests, or commercial usage.Any additional fee will be discussed before I proceed.
2. CLIENT RESPONSIBILITY, APPROVAL & REVISIONSClients are responsible for providing clear descriptions, accurate references, and any necessary information before work begins.Clients are also responsible for reviewing sketches and WIPs carefully before approving them.Once a stage has been approved, visible elements shown at that stage are considered accepted.If I make a clear mistake that contradicts the agreed brief or provided references, I will correct it free of charge.Changes caused by the client changing their mind after approval are not considered artist errors and may require an additional fee.If references are incomplete and I am given creative freedom to interpret missing details, reasonable artistic decisions made during the process will not be considered errors.
3. CANCELLATIONS, REFUNDS & CHARGEBACKSIf the client cancels before work begins, a full or near-full refund may be available, excluding any non-refundable payment processing fees.Once work has begun, refunds will be based on the amount of unfinished work remaining.Completed work is non-refundable.If I am unable to complete the commission for reasons on my side, the client will receive a refund for the unfinished portion.Artwork and WIPs created before cancellation remain copyrighted by me.Fraudulent or unjustified chargebacks may result in loss of permission to use the commissioned artwork and refusal of future commissions.
4. COPYRIGHT & USAGEUnless otherwise agreed in writing, I retain copyright and authorship of all commissioned artwork.The client receives permission to use the artwork only within the agreed scope and does not receive ownership of the copyright itself.Personal-use commissions may not be used for merchandise, advertising, branding, monetized content, subscription rewards, resale, or any other revenue-generating purpose without a separate commercial license.My artwork may not be used for generative AI training, AI datasets, AI editing or generation, NFTs, or stock redistribution.Clients may crop or resize artwork for reasonable personal use, but may not claim the artwork as their own creation or significantly alter it in a way that misrepresents the original work.
5. POSTING & PRIVACYUnless otherwise agreed beforehand, I may display finished commissions and selected WIPs or process material on my social media, portfolio, or commission examples.If the client wants the commission to remain private or unreleased, this must be discussed before work begins.Private commissions may require an additional fee.
6. DELIVERY & CORRECTIONSFinal files and included extras will follow the terms agreed upon before work begins.Clients are responsible for backing up delivered files. I cannot guarantee permanent storage.Clients have 7 days after final delivery to report genuine mistakes that clearly contradict the approved brief or references.Artist errors will be corrected free of charge.New ideas, preference changes, or changes to previously approved elements are not considered artist errors and may require an additional fee.After the 7-day correction period, the commission is considered completed and closed.
7. CLIENT CONDUCTI reserve the right to pause, cancel, or refuse further work in cases of harassment, threats, repeated boundary violations, deliberate violations of these Terms, fraudulent chargebacks, or misuse of the artwork.Any refund in such cases will depend on the amount of unfinished work remaining.
8. AGREEMENTI may update these Terms of Service at any time.A commission will follow the version active at the time the commission was confirmed, unless otherwise agreed in writing.By confirming a commission and completing payment, the client confirms that they have read and agreed to these Terms.
